Terms of Service

These terms govern your use of the PanelGear website and software (together, the “Service”). By accessing or using the Service, you agree to these terms. If you don’t agree, please don’t use the Service.
What the Service is for
PanelGear is business software for panel and paint shops. It is designed to help you:
- record quote requests, customers, vehicles and repair photos;
- draft repair quotes — including drafts generated automatically from photos using artificial intelligence;
- reference insurer rate and allowance information you have configured or supplied;
- collaborate with your team and communicate with customers; and
- exchange information with other systems you already use, where you choose to connect them.
What the Service is not
This matters, so we’d rather be blunt about it than bury it. The Service is an administrative and drafting tool. It is not:
- a substitute for the judgement of a qualified panel technician, estimator, assessor or engineer;
- a means of determining whether a vehicle is safe, roadworthy, structurally sound, or correctly repaired;
- a source of legal, insurance, financial, tax or safety advice, and nothing in it should be relied on as such;
- an authority on what any insurer will accept, authorise or pay; or
- your accounting, estimating, invoicing or record-keeping system of record.
You are the repairer. Every decision about how a vehicle is assessed, repaired, priced and released remains yours, and you are responsible for making it in line with manufacturer procedures, your insurer agreements, and applicable law and safety standards.
AI-generated drafts are estimates
Some features draft quotes, identify parts and assess damage automatically, including from photographs. These outputs are a starting point only. They are produced by statistical models, they will sometimes be wrong, and they can miss damage entirely — particularly damage that is not visible in a photograph, such as structural, mechanical, electrical or concealed damage.
You must review, correct and approve every quote and assessment before you rely on it, send it to a customer or insurer, or begin work. PanelGear is not liable for any loss arising from an unreviewed draft, an under-quoted repair, or damage the software did not detect.
Insurer rates, allowances and repair guidelines shown in the Service are reference information based on what you or your insurer partners have configured. They may be out of date or incomplete, and they do not bind any insurer. Confirm authorisation through your usual channels before you rely on them.
Accounts, organisations and users
When you sign up you create an organisation — your shop — and become its administrator. Administrators can invite other users, set their roles, and manage the organisation’s billing.
You’re responsible for keeping your sign-in details secure, for who you invite into your organisation, and for what happens under your account and theirs. Please give us accurate information and keep it up to date. Let us know promptly if you think your account has been used without your permission.
You must be at least 18 and authorised to accept these terms on behalf of your business.
Free and paid plans
The Service has a free plan and one or more paid plans. What each plan includes — including any monthly limit on AI-generated damage assessments — is shown in the app on your billing page and may change over time.
- The free plan is genuinely free. No card is required and there is no time limit on it.
- Usage limits are enforced. If you reach your plan’s monthly allowance for AI assessments, that feature pauses until the allowance resets or you upgrade. The rest of the Service, and everything already in your account, keeps working normally.
- We may change plans and limits. If we reduce what an existing paid plan includes, or increase its price, we’ll give you reasonable notice first and you can cancel before the change takes effect.
Billing and payments
Paid subscriptions are sold and processed by Lemon Squeezy, which acts as the merchant of record and authorised reseller for PanelGear. When you buy a subscription, your purchase and payment are with Lemon Squeezy, and their terms and privacy policy apply to that transaction alongside these terms.
- We never see your card. Card details are handled by Lemon Squeezy and their payment providers. We store only your plan, subscription status, billing email and a masked card summary so we can show you what you’re on.
- Subscriptions renew automatically at the interval shown at checkout, until cancelled.
- Taxes, including GST where it applies, are calculated and shown at checkout and on your invoice.
- You can cancel at any time from your billing page. Cancellation takes effect at the end of the period you’ve already paid for — you keep your plan until then, and move to the free plan afterwards.
- Payments are generally non-refundable, except where required by law or where we agree otherwise. If something has gone wrong, talk to us — we’d rather sort it out.
- If a payment fails, we’ll let you know and your plan will continue for a short grace period. If it stays unpaid, your organisation moves to the free plan. Your data is not deleted for non-payment.
Acceptable use
You agree not to:
- use the Service unlawfully or for any unlawful purpose;
- use the Service to produce quotes, assessments or records you know to be false or misleading, including for the purposes of an insurance claim;
- upload content you don’t have the right to upload, or personal information you aren’t entitled to share with us;
- disrupt, interfere with, probe or attempt to gain unauthorised access to the Service, its systems, or another organisation’s data;
- work around usage limits, plan restrictions or access controls, or create multiple accounts to avoid them;
- use the Service or its outputs to build or train a competing product, or resell access to it; or
- copy, modify, reverse engineer or misuse the Service except as these terms or the law allow.
Your data
You keep ownership of the content and data you put into the Service. You grant us the permission we reasonably need to host, process, transmit and back up that data so we can provide the Service to you and support you when you ask.
Photographs you upload are processed by automated systems, including third-party AI providers, to detect vehicle parts and damage. We handle personal information as described in our Privacy Policy. You’re responsible for having a lawful basis to give us the customer information you upload.
You can export or request a copy of your data while your account is active. If your organisation is closed, we may delete your data after a reasonable period — so keep your own records of anything you need to retain for tax, insurance or compliance purposes.
Availability and changes to the Service
We work to keep the Service available and reliable, but we don’t promise it will be uninterrupted or error-free. We may update, change or remove features, and we may need to take the Service down for maintenance. Features described as beta, preview or experimental may change or be withdrawn at any time.
Third-party services and integrations
The Service may integrate with or link to third-party products we don’t control — including payment providers, AI providers, and estimating or insurer systems you choose to connect. We’re not responsible for those products, their availability, or what they do with data you direct us to send them. Your use of them is subject to their own terms.
Where you give us credentials for a third-party system, you confirm you’re permitted to use them that way, and that doing so doesn’t breach your agreement with that provider.
Intellectual property
The Service, including its software, branding, logos and content, is owned by or licensed to us and is protected by intellectual property laws. These terms don’t transfer any of those rights to you beyond the right to use the Service as intended, for the duration of your subscription.
Disclaimers
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we don’t warrant that the Service will be uninterrupted, error-free, secure, or fit for a particular purpose, and we don’t warrant the accuracy, completeness or suitability of any quote, assessment, measurement, price or recommendation it produces.
Limitation of liability
To the maximum extent permitted by law, PanelGear isn’t liable for any indirect, incidental, special or consequential loss, or for lost profits, lost revenue, lost business, lost data, or the cost of substitute services, arising from or connected with your use of the Service.
In particular, and without limiting the above, we aren’t liable for: loss arising from a quote or assessment that was inaccurate, incomplete or under-priced; work carried out or not carried out on a vehicle; damage to any vehicle or property; injury arising from a repair; a dispute with a customer, insurer or third party; or a claim that was declined, short-paid or reopened.
Where liability cannot be excluded, our total liability to you for all claims in any 12-month period is limited to the greater of NZ$100 or the amount you paid us for the Service in the 12 months before the claim arose.
Nothing in these terms limits rights that can’t be excluded under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986. The Service is supplied for business purposes, and where you acquire it for the purposes of a business you agree that the Consumer Guarantees Act does not apply, and that sections 9, 12A and 13 of the Fair Trading Act do not apply.
Indemnity
You agree to indemnify us against claims, losses and costs (including reasonable legal costs) brought by a third party and arising from your use of the Service in breach of these terms, from content you upload, or from repair work you carry out.
Suspension and termination
You can stop using the Service at any time, and cancel a paid plan from your billing page. We may suspend or end access if these terms are breached, if your use puts the Service or other customers at risk, or where we reasonably need to. Where it’s practical to do so, we’ll tell you first and give you a chance to put things right.
Changes to these terms
We may update these terms from time to time. Changes take effect once posted here, and we’ll update the “last updated” date. If a change materially reduces your rights while you’re on a paid plan, we’ll give you reasonable notice. Continuing to use the Service means you accept the updated terms.
Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any disputes.
